*SonicAire Compliance Guarantee: SonicAire will provide a full refund on the cost of fans (or reimburse the cost of any imposed fine, whichever is less) to any customer that is found to be in non-compliance with NFPA fugitive dust standards as set forth in NFPA 652-2019, 654-2020, 664-2020, and 61-2020; provided, that the following conditions are met: (1) the SonicAire fans were installed pursuant to a plan approved by SonicAire, and installed by a SonicAire certified installer or had a SonicAire start-up commissioning performed, (2) the customer has performed all recommended preventative maintenance on the fans, (3) the customer has not modified the placement or operation of the fans in any manner, (4) the fans are being used as directed and fan operation has not been suspended for any significant duration for any reason (e.g., power outage or fan malfunction), (5) the customer has not modified the operations conducted in the facility or materially changed the environmental conditions, and (6) for a full refund of the cost of the fans, the customer returns the fans along with a copy of the OSHA report that specifically references non-compliance with the NFPA fugitive dust standards in the portion of the customer’s facility where SonicAire fans were installed and operating. This guarantee will end upon the earlier of 3 years after purchase or on the date the NFPA fugitive dust standards are materially changed. SonicAire’s one-time reimbursement of the fine, or refund of the cost of the fans paid by the customer will be the customer’s sole and exclusive remedy for any breach of this guarantee.
